Our client was tasked with engineering and delivering the façade system for a 38-story tower project, including the supply and installation of the curtain walling, sliding door balconies, and construction of a glass canopy.
The dispute between the parties concerned the various factors that delayed the completion of the façade works under the sub-contract. It also addressed the main contractor’s counterclaims for delays to the overall project completion date. The parties were in dispute regarding the specific reasons for the delays and how the delays impacted both the sub and main contract programmes.
The client’s legal counsel engaged J.S. Held to deliver an independent expert opinion on the causes of the delay to the façade system installation and the impact the delays had on the wider project. This involved adopting a suitable delay analysis methodology to thoroughly investigate the critical path and identify the contributing factors to the delay. J.S. Held prepared an independent expert opinion regarding the quantum, which included preparing a loss and expense assessment related to the delays and reviewing contentious variations. In addition to this, our team provided an architectural expert review of the technical design and installation requirements associated with the building cladding and maintenance systems, along with an opinion on the defects alleged to have affected them.
J.S. Held conducted a comprehensive delay analysis to identify the critical path and calculated the completion date. Once we identified the causes of the delay, we liaised with counsel, who then formed their opinion regarding the liability for the delays identified.
Based on our comprehensive analysis and well-founded opinion, our client felt assured and confident in initiating the adjudication process. Our detailed and methodical approach to the analysis ensured that the technical design and installation workmanship, together with all aspects of the delays and their financial implications, were meticulously examined. Our client was well-prepared to present a robust case in the adjudication proceedings.
