The Situation

This project involved a $13M new prototype plant intended to convert unused poultry portions from a processing plant into high-grade oils, natural gases, minerals, and water through heat and pressurization. The plant consisted of several outlying buildings. The mechanical contractor was terminated with approximately 90% completion after hundreds of design changes and doubled labor costs. The mechanical contractor requested damages exceeding $5M in additional labor, material, and extended general conditions due to project extension, scope changes, and disruption.

How We Advised

The owner of the project counterclaimed after its investigations indicated that there was significant faulty work. J.S. Held was engaged by the mechanical contractor’s legal counsel to provide consulting services related to construction scheduling and cost matters within the context of a dispute between the mechanical contractor, the construction manager/general contractor, and the owner. This matter was resolved via negotiation.
