The other party suffered a catastrophic natural disaster that damaged the pipeline and facilities within its territory. Consequently, the parties were in dispute over responsibility for the loss of revenue due to each other’s pipeline operability issues.
The Middle Eastern government engaged J.S. Held as delay and quantum experts in the context of an ICC Arbitration. The scope of services involved providing a technical delay and quantum analysis assessment, including instances of terrorist sabotage damage and its impact on pipeline operability, as well as project planning for reconstruction and repair. The assessment included opining on how the events would have influenced the operation of the pipeline, the degree (and duration) of repairs required to re-establish service, and what might be a realistic plan for rehabilitation and maintenance of the pipeline. Oral testimony was given at a hearing before the ICC in Paris.
