J.S. Held was engaged to conduct a site inspection and review the builder’s risk cost claim. Upon review of the contract documents received through J.S. Held’s request for information (RFI) process, J.S. Held determined that some phases of the project had already received substantial completion and certificates of occupancy and were being occupied by the property owner at the time of loss. J.S. Held brought this to the attention of the insurance carrier and questioned whether the builder’s risk policy still covered phases that were completed and occupied prior to the loss. The carrier confirmed that only project phases that were actively under construction at the time of the loss were covered by the policy. J.S. Held separated the claimed costs by project phase and determined the only covered portion of the claim consisted of stored materials intending to be installed for an active project phase, the amount of which fell below the deductible.
