The project owner engaged J.S. Held to evaluate Engineering , Procurement, and Construction Management (EPCM) of the project. Disputes arose, ultimately resulting in an ICC arbitration process.
The project owner retained J.S. Held to provide an independent expert evaluation of the performance of one of the EPCMs on the project. Our team thoroughly reviewed multiple project aspects, including the EPCM’s management and oversight of the contractor’s performance and management of quality to achieve project completion in the backdrop of applicable industry practices. We developed several detailed reports and engaged in extensive discussions with the opposing expert, preparing joint memorandums outlining areas of agreement and disagreement.
We provided expert testimony during the ICC arbitration, which included participating in a joint testimony (hot-tubbing) session with the opposing expert. This approach helped clarify critical points of contention between the parties that stemmed from the project management challenges. Our expert analysis and testimony contributed to the clarity and strength of our client’s position in the arbitration.
