Read MoreWith deep experience advising clients on matters involving renewable energy, our construction advisory experts were engaged to provide independent expert opinion in a $195M dispute concerning the construction of a 375 megawatt-peak (MWp) solar photovoltaic (PV) power plant in Mexico. The project included the construction of the PV plant and the high-voltage (HV) connection works.
As part of the Dispute Adjudication Board (DAB) Proceedings (method of dispute resolution in construction), we delivered expert opinion on matters related to delay by way of applying the appropriate delay analysis methodology, the quantum of claims by the referring party, and the counterclaims raised by the responding party.
Our work included assessing delays to the project works as governed by the scheduled dates and as it pertains to quantum, an assessment that relates to additional work costs, change orders due to change in law and COVID-19, extension of time and acceleration, and evaluation of financing impacts and liquidated damages. Our team’s in-depth knowledge and experience in the design, complexity, and implementation of projects supported the effective resolution of this high-risk infrastructure dispute.
