The Situation

This project involved the construction of an 80 MW solar photovoltaic (PV) power plant, comprising more than 300,000 polycrystalline PV modules, along with associated switchyards and connections to high-voltage (HV) transmission lines. The plant was completed and commissioned in 2019.

How We Advised

J.S. Held provided expert opinions on matters of delay, claim quantum, and specific technical issues under dispute, including defective works. We prepared detailed reports and provided oral testimony during a two-week hearing. The key issues under dispute included the cause of the construction delay and the delay in exporting power to the grid. We conducted a comprehensive windows delay analysis, assessed delay liquidated damages, and examined defects in the work. Our team addressed issues related to contractor termination and costs for additional work claims. We also evaluated the financing costs and the achievement of substantial and final completion. The dispute value was $20M, with the arbitration governed by the ICC procedural rules.
