The Situation

This project involved a 500 MW offshore wind farm consisting of 50 wind turbines, each with an estimated 10 MW capacity, mounted on monopiles with an offshore substation (OSS). The scope included wind turbine fabrication and installation, monopile and transition piece fabrication, foundation transportation and installation (FTI), array cable fabrication and installation, and OSS fabrication and installation. The OSS installation was completed in 2023, while the wind turbine generator (WTG) installation and commissioning are scheduled for completion in 2025.

How We Advised

J.S. Held provided contract and claims advisory services, supporting the developer throughout the construction process. Our work addressed contractor claims related to delays, disruption, and quantum. Along with preparing contract assessments and playbooks, we conducted detailed analyses of delay and disruption claims for OSS fabrication and commissioning, covering delay analysis and quantum. Our experts conducted time slice windows assessments to determine the cause of critical delays and supported the FTI package with as-planned versus as-built delay analyses. We assessed delays caused by adverse climatic conditions, evaluated costs associated with the extension of time claims, and prepared the developer’s counterclaim. Additionally, we evaluated disruption costs under the FTI package through an in-depth assessment of the Daily Progress Reports (DPR). We managed the settlement of delay claims under the WTG package using an as-planned versus as-built approach, incorporating detailed DPR assessments.
