Delay & Disruption Claim
Owned by the Port Authority of New York and New Jersey, this transportation hub, located at Ground Zero, houses the new PATH station as well as a retail complex. The unique building was imagined by architect Santiago Calatrava, who designed the structure to resemble a bird taking flight. The main concourse above the train tracks links the train station to Battery Park, which is located on the west side of the World Trade Center site.
J.S. Held was retained by one of the concrete superstructure contractors to prepare a delay and disruption claim and resulting damages on its behalf. The most difficult task was to prove that the delays and disruptions arose from extreme impacts by others, beyond what the contractor could have reasonably contemplated, even though the contract explicitly included clauses pertaining to the fact that the contractor was made aware of congestion-related issues due to tight site logistics. The claim was successfully negotiated at a value of approximately $4 million.
