By the time the concessionaire initiated ICSID arbitration to claim lost profits and additional costs, the project had only been partially executed.
J.S. Held was engaged as a third-party expert by the client in the ICSID arbitration. Our team prepared three expert reports, including a forensic delay/technical analysis, a quantum analysis, and a traffic analysis. These reports provided expert opinions on all the disputed issues and responded to the claimants´ experts. Our analysis examined all the events that impacted the project, assessed their effects, and determined which party was responsible and the extent of the consequences. Additionally, we supported the document production phase and were cross-examined during the arbitration hearing.
