The Situation

A contractor was engaged to build a photovoltaic power plant in Latin America with a capacity of over 100 MW, under an EPC contract. The client was responsible for securing permits and sourcing the main equipment, while the contractor was responsible for design, procurement (excluding main materials), construction, and commissioning of the solar field and transmission line. The project experienced significant delays, primarily due to issues with external parties and suppliers of key materials. These delays resulted in additional costs for the contractor.

How We Advised

The contractor engaged J.S. Held to act as third-party experts in the ICC arbitration related to the project disputes. Our team prepared a forensic delay analysis, a quantum analysis, and a technical analysis. These reports provided expert opinions on all the disputed issues and included a reply to the counterclaim presented by the employer, who sought to apply delay damages and asserted a set-off for alleged defects. Additionally, we supported the document production phase and were cross-examined during the arbitration hearing.
