The Situation

A report of a fatal hit-and-run traffic collision involving a vehicle and a motorized scooter was called in, but police misidentified roadway evidence and could not tie the suspect vehicle to the crash scene. The Defense hired a witness that could exonerate the defendant due to the misinterpreted roadway evidence.

How We Advised

Our team performed a site inspection, vehicle inspections, and a review of police evidence and roadway photos. Afterward, we were able to tie the suspect vehicle to tire marks on the roadway that had not been located by police. We showed contact points between the vehicles and the operator of the scooter and were able to determine the striking vehicle’s speed via surveillance camera video interpretation and photographs located during the investigation. We presented evidence in deposition and trial. As a result, the Prosecutor’s office was able to secure a conviction for vehicular manslaughter, hit-and-run, and related charges.
