Energy and Environmental Advisory expert, John Peiserich, Esq., will join a panel of experts at the FDCC 2024 Winter Meeting to discuss “ESG Litigation Lands in America.”

The panel will take a deep dive into a case study involving a federally regulated Canadian teachers' pension fund invested in an oil and gas company focused on acquiring, developing, and exploiting unconventional, onshore oil and natural gas reserves, which set off a sequence of events that may end in litigation.


Topics will include:

  • Impacts on traditional financing by a bank’s decarbonization of its lending portfolio
  • How pledging to be “net zero by 2050” was intended to increase access to financing
  • Allegations by an NGO that the plan to reach that target has no credibility
  • Implications for the Canadian pension fund's ESG metrics
  • Why the fund is threatening a greenwashing lawsuit against the Texas company
