J.S. Held Strengthens Family Law Practice with Asset Acquisition of Luttrell Wegis

The Situation

We were engaged to assist a large law firm in Atlanta in defending a complex lawsuit that alleged legal malpractice, breach of fiduciary duty, fraud, conspiracy, and RICO. This law firm was hired to represent the independent trustees in a large family trust created by a wealthy businessman to benefit his lineal descendants. The lawsuit alleged that our client, the law firm, was aware of and created numerous transactions between the trust and trustees, the nature of which caused assets of the trust to flow to the trustees. The complaint asked for significant compensatory damages and requested that those damages be tripled under the Georgia state RICO statute.

How We Advised

Our role was to act as an expert witness and assist the trier of fact in understanding the complex structure of the trust along with the approximately 100 other entities that were created to hold ownership interests in the trust’s assets. Additionally, we were tasked with rebutting the plaintiff’s damage calculation. We attacked the plaintiff’s damage calculation by demonstrating that he had ignored certain rulings made by the court that, had he adequately considered such orders, would greatly reduce the damage amount. Additionally, we proffered that many of his separate heads of damage were procedurally and computationally defective. We assisted our client’s counsel in a comprehensive Daubert motion directed against the plaintiff’s damage expert. Soon after this motion was filed, the case was settled.
